เรื่อง    ขอให้นำผู้กระทำผิดค้ามนุษย์โรฮิงญาที่ยังลอยนวลเข้าสู่กระบวนการยุติธรรมและขจัดการค้ามนุษย์โรฮิงญาที่ยังเติบโตอยู่ในปัจจุบัน

ตามที่สมาชิกสภาผู้แทนราษฎรจากพรรคก้าวไกล ได้หยิบยกกรณีปัญหาของการค้ามนุษย์โรฮิงญาในพื้นที่ สภ.ปาดังเบซาร์ จังหวัดสงขลา ที่ทำให้ผู้ลี้ภัยชาวโรฮิงญาจำนวนมากต้องประสบชะตากรรม มีเด็กและผู้ใหญ่จบชีวิตลงในประเทศไทยอย่างคาดไม่ถึง และทำให้ พล.ต.ต. ปวีณ พงศ์สิรินทร์ อดีตรองผู้บัญชาการตำรวจภูธรภาค 8 ซึ่งทำหน้าที่สืบสวนสอบสวนคดีในขณะนั้นต้องลี้ภัยในประเทศออสเตรเลีย พล.ต.ต. ปวีณ ได้ส่งสำนวนพยานหลักฐานที่แน่นหนาต่ออัยการสูงสุดและสั่งฟ้องในข้อหาค้ามนุษย์ อาชญากรรมข้ามชาติ และข้อหาอื่นที่เกี่ยวข้องได้สำเร็จทำให้ศาลอาญาและศาลอุทธรณ์พิพากษาลงโทษจำคุกจำเลยไปหลายสิบราย รวมถึงลงโทษ พล.ท.มนัส คงแป้น ผู้ต้องขังคนสำคัญ (เสียชีวิตในเรือนจำเมื่อวันที่ 2 มิถุนายน 2564) เมื่อพล.ต.ต.ปวีณ ลี้ภัยไปต่างประเทศ ทำให้การสืบสาวไปถึงผู้ค้ามนุษย์ระดับสูงที่ยังลอยนวลชะงักงัน จนเป็นเหตุให้ขบวนการค้ามนุษย์เติบโต การนำชาวโรฮิงญาเข้ามาอย่างผิดกฎหมายยังมีอยู่ด้วยน้ำมือของคนกลุ่มเดิมในปัจจุบัน และปฏิเสธไม่ได้ว่ามีเจ้าหน้าที่ตำรวจและทหารระดับล่างและระดับสูงร่วมกระทำการทุจริตประพฤติมิชอบอยู่ด้วย

การค้ามนุษย์เป็นอาขญากรรมข้ามชาติ เป็นธุรกิจที่สร้างรายได้อย่างมหาศาล การที่ขบวนการค้ามนุษย์ยังคงดำเนินธุรกิจอยู่ได้เพราะมีเจ้าหน้าที่รัฐเข้าไปมีส่วนร่วมกับขบวนการค้ามนุษย์ หากรัฐบาลไทยยังไม่มีมาตรการเชิงรุกในการปราบปรามจับกุมผู้ค้ามนุษย์ ไม่ว่าจะเกิดกับผู้ลี้ภัยโรฮิงญา ชาวพม่า ชาวประมง หญิงและเด็กจากประเทศเพื่อนบ้าน หรือยังไม่กำจัดกลุ่มอิทธิพลและอาชญากรในเครื่องแบบให้สิ้นซาก ธุรกิจการค้ามนุษย์ก็จะยังคงมีอยู่ และขยายตัวเติบใหญ่ต่อไป ซึ่งจะเป็นผลให้ประเทศไทยถูกปรับจาก Tier 2 Watch List มาเป็น Tier 3 ตามกฎหมายสหรัฐว่าด้วยการปกป้องเหยื่อการค้ามนุษย์ (Trafficking Victims Protection Act of 2000 หรือ TVPA)ที่ใช้จัดระดับกับทุกประเทศทั่วโลก เพราะไม่เห็นความพยายามในการแก้ปัญหาค้ามนุษย์อย่างมีนัยยะสำคัญ (Significant Efforts) ก็จะส่งผลต่อภาพพจน์ของกระบวนการยุติธรรมไทยทั้งหมด ส่งผลต่อภาพลักษณ์ของประเทศไทยที่เป็นดินแดนแห่ง เซ็กซ์ทัวร์ (Sex Tourism) ให้ตกต่ำมากขึ้น รวมถึงส่งผลต่อการค้า การลงทุน ของประเทศไทยด้วย องค์กรต่าง ๆ จึงมีข้อเสนอต่อนายกรัฐมนตรีและรัฐบาล ดังต่อไปนี้

1. ขอให้ท่านนายกรัฐมนตรีและรัฐบาล ใช้อำนาจหน้าที่สานต่อการดำเนินคดีการค้ามนุษย์ดังกล่าวในพื้นที่จังหวัดสงขลาที่สะดุดหยุดลงไปเมื่อปี 2558 และติดตามเส้นทางการค้ามนุษย์ในภาคใต้กับภาคตะวันตกทุกจังหวัด เพื่อนำผู้กระทำผิดมาลงโทษอย่างถอนรากถอนโคน
2. ขอให้หน่วยงานที่เกี่ยวข้องกับการปราบปรามการทุจริตประพฤติมิชอบ รวมถึงกระทรวงยุติธรรมและคณะกรรมมาธิการของรัฐสภาที่เกี่ยวข้อง เรียกเจ้าหน้าที่และหน่วยงานที่เกี่ยวข้องมาให้ปากคำ ข้อมูลข้อเท็จจริงเชิงลึก ถึงสาเหตุที่ทำให้การค้ามนุษย์ และการลักลอบขนแรงงานผิดกฎหมายที่ยังคงเติบโตต่อเนื่องมาได้เป็นเวลากว่า 10 ปี ใครอยู่เบื้องหลัง ขบวนการที่ไปขนชาวโรฮิงญาและขบวนการลักลอบขนแรงงานผิดกฎหมายเข้ามาในประเทศไทย ตรวจสอบเส้นทางทางการเงิน มุ่งแก้ปัญหาที่ต้นตอ ไม่ใช่แก้ปัญหาที่ปลายเหตุ
3. ให้มีกลไก หรือมาตรการการทำงานที่สามารถตรวจสอบถ่วงดุล การทำงานของตำรวจ ทหาร กำนัน ผู้ใหญ่บ้านในพื้นที่ชายแดนและจุดเสี่ยงต่อการค้ามนุษย์ เลิกล้มระบบอุปถัมภ์ ความคิด ค่านิยม ความสัมพันธ์นับถือส่วนตัว ที่มักเป็นอุปสรรคในการปฏิบัติหน้าที่อย่างตรงไปตรงมา เพื่อให้สามารถปฏิบัติการณ์ป้องกันและปราบปรามการค้ามนุษย์ได้อย่างเต็มที่
4. การค้ามนุษย์เป็นการละเมิดกฎหมาย และละเมิดสิทธิมนุษยชนอย่างรุนแรง โดยระบุไว้ชัดเจนในปฏิญญาสากลว่าด้วยสิทธิมนุษยชน (UDHR) ข้อที่ 3, 4, 5, 6, 7, 8, 9 กล่าวคือรัฐบาลและเจ้าหน้าที่รัฐควรตระหนักว่า มนุษย์ทุกคนมีสิทธิที่จะมีชีวิตอยู่ โดยไม่ตกเป็นทาสหรือการค้าทาส ไม่ถูกทรมาน ต้องได้รับการคุ้มครองทางกฎหมายไม่ถูกคุมขังหรือเนรเทศตามอำเภอใจซึ่งบุคลากรของภาครัฐและหน่วยงานรัฐต้องไม่ละเมิดสิทธิมนุษยชนหรือร่วมรับผลประโยชน์จากการค้ามนุษย์เสียเอง
5. เร่งให้มีการปฏิรูปกระบวนการยุติธรรมโดยเร่งด่วนให้มีความโปร่งใส เพื่อให้พนักงานตำรวจ ทหาร อัยการ ศาล นิติวิทยาศาสตร์ และฝ่ายปกครองมีความมั่นใจในการทำคดีค้ามนุษย์ เก็บรวบรวมพยานหลักฐานไว้ที่ทุกหน่วยงานและให้มีการคุ้มครองความปลอดภัยผู้ปฏิบัติงานทุกคน จากการถูกข่มขู่ คุกคามโดยผู้มีอิทธิพล เป็นเหตุให้อยู่ในประเทศไม่ได้ หรือถูกกลั่นแกล้งในหน้าที่การงาน ถูกโยกย้ายออกนอกพื้นที่โดยไม่มีเหตุผลทั้งที่บางคนปฏิบัติหน้าที่อย่างซื่อสัตย์สุจริต

สสส. และองค์กรตามรายนามข้างท้ายนี้หวังเป็นอย่างยิ่งว่า เรื่องการค้ามนุษย์ที่เกิดกับชาวโรฮิงญา      ซึ่งไม่ได้รับการเหลียวแลจากประเทศต้นทาง และการก่ออาชญากรรมที่เกิดกับคนสัญชาติอื่นในประเทศไทย      จะได้รับการช่วยเหลือดูแล จนได้รับความเป็นธรรม ไม่ล่าช้า  รัฐบาลต้องมีมาตรการป้องกันปัญหา ปราบปรามผู้กระทำผิดทุกระดับอย่างจริงจัง แสดงให้เห็นความพยายามในการแก้ปัญหาค้ามนุษย์อย่างมีนัยยะสำคัญ เพื่อมิให้ถูกปรับสถานะจาก Tier 2 Watch List มาเป็น Tier 3 ในช่วงเดือนมิถุนายน หรือกรกฎาคม ที่จะถึงนี้

Open Letter to the Prime Minister of Thailand

Subject: Scot-free traffickers of Rohingya people must be brought to justice and still growing

  human trafficking of Rohingya people must be eliminated

To:      General Prayuth Chan-ocha, Prime Minister of Thailand

            Referring to a debate in the House of Representatives where an MP from Move Forward Party raised the case about human trafficking of Rohingya people in the responsible area of Padang Besar Police Station in Songkhla Province of which many Rohingya refugees suffered a horrible fate, many children and adults unexpectedly lost their lives, and Police Major General Paween Pongsirintr, a former Deputy      Commander of the Provincial Police Region 8 who investigated  this case had to take refuge in Australia.  Pol. Maj. Gen. Praween had submitted strong evidence to the Attorney General and got the criminals successfully prosecuted for the crime of human trafficking, international crime, and other related charges, resulting in the Criminal Court and Appeal Court sentencing tens of them, including Lieutenant General Manas Khongpaen, a keyman in the trafficking syndicate who died in prison on 2^nd June 2021, to long-time imprisonment.  When Pol. Maj. Gen. Praween took refuge in a foreign country, further investigation to identify scot-free high-level members of the trafficking syndicate became installed, resulting consequently in the continuing growth of the trafficking syndicate.  Illegal human trafficking of Rohingya people therefore still exists by the same group nowadays and it cannot be denied that both low-level and high-level police and military officers have taken part in this crime and corruption.

            Human trafficking is an international crime and a business that generates enormous incomes.  Human trafficking syndicates can continue to carry out their business because state officials take part in them.  If the Royal Thai Government still have no proactive measures to suppress those who conduct trafficking of fellow human beings, whether they are Rohingya refugees, Burmese, fishermen, women and children from neighbouring countries, or eliminate criminals in uniform, human trafficking business will continue to exist and grow even further.  This has already resulted in Thailand being downgraded from Tier 2 Watch List to Tier 3 according to the US Trafficking Victims Protection Act of 2000 or TVPA which has been used to rank all countries around the world because no significant efforts have been made to tackle the human trafficking problem, affecting the image of Thailand’s justice system as a whole, further downgrading image of Thailand as the Land of Sex Tourism, and affecting Thailand’s trade and investment, organisations whose names are listed below, therefore, have recommendations for the Prime Minister and his government as follows:

1. The Prime Minister and government use their authority to carry on the prosecution of this case in Songkhla Province which has been installed since 2015 and monitor human trafficking routes in all provinces of the Southern Region and Western Region to exterminate human trafficking syndicates and bring wrongdoers to receive punishment.
2. State agencies related to the suppression of crimes and corruption, including the Ministry of Justice and related Commissions of the Parliament call related officials and agencies to testify, giving in-depth information about what causes human trafficking and illegal trafficking of labour to be able to continue growing for more than 10 years and who are behind the syndicates that have trafficked Rohingya people and illegal labour into Thailand, monitoring their financial routes, aiming to solve the problems at their root causes instead of the results. There must be working mechanisms or measures that can check and balance works carried out by police, the military, sub-district chiefs (Kannan), and
3. village headmen in border areas and at points that are at risk of human trafficking. A patronage system, norms and values, and personal relations of trust that often are obstacles against the frank performance of duty by officials must be abolished, so that they could perform their duties to fully prevent and suppress human trafficking.
4. Human trafficking is a very serious violation of laws and human rights as indicated clearly in Articles 3, 4, 5, 6, 7, 8, and 9 of the Universal Declaration of Human Rights (UDHR). The government and state officials must recognize that all human beings have the right to live without being slaved or subjected to slavery, without being tortured, and  be legally protected without being detained or expatriated arbitrarily. State personnel and state agencies themselves must not violate human rights or share benefits gained from human trafficking.
5. Thailand’s justice system must be urgently reformed for transparency, so that police officers, military officers, state prosecutors, courts, forensic science officers, and administrative officers could be confident to work on human trafficking cases, collect evidence at all related agencies, and all officials are safely protected from intimidation and threats by influential persons that they could not live in the country or bullying in their working positions, being moved out of areas under investigation without reason despite some of them honestly perform their duties.

Union for Civil Liberty and organisations whose names are listed below very much hope that human trafficking that has occurred with Rohingya people without being taken care of at the country of origin, and crimes against people of other nationality in Thailand would be taken care of until victims receive justice without delay.  The government must have measures to prevent the problem and actively suppress wrongdoers at all levels, showing significant efforts to solve the human trafficking problem to prevent Thailand from being downgraded from Tier 2 Watch List to Tier 3 of the TVPA in this coming June or July.
